Terms of Service

By accessing or using the website at www.emperorcreativestudio.com (the "Site") or engaging Emperor Creative Studio ("we", "our", "us") for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

Emperor Creative Studio provides digital agency services including, but not limited to, website and mobile development, AI SaaS development, VR/immersive experiences, game development, and blockchain solutions. The specific deliverables, timelines, and fees for any engagement are defined in a separate written agreement or Statement of Work ("SOW") signed by both parties.

Upon receipt of full payment, all custom deliverables created specifically for a client become the client's property, unless otherwise specified in the SOW. Emperor Creative Studio retains the right to display completed work in its portfolio unless the client requests confidentiality in writing.

All pre-existing tools, frameworks, libraries, and methodologies used by Emperor Creative Studio remain our intellectual property. Open-source components are governed by their respective licences.

You agree not to:

• Use the Site for any unlawful purpose or in violation of any regulations.
• Attempt to gain unauthorised access to any part of the Site or its related systems.
• Transmit spam, malware, or any harmful code through the Site's forms or chat.
• Scrape, crawl, or extract data from the Site without prior written consent.

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Emperor Creative Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services. Our total liability for any claim shall not exceed the amount paid by you for the services giving rise to the claim in the 3 months preceding the claim.

Unless otherwise agreed in writing, our standard payment terms are 50% upfront and 50% upon project completion. Invoices are due within 14 days of issue. Late payments may incur interest at 1.5% per month. We reserve the right to suspend work on overdue accounts.

Both parties agree to keep confidential any proprietary or sensitive information shared during an engagement. This obligation survives termination of the relationship for a period of 2 years.

Either party may terminate a project engagement with 14 days' written notice. In the event of termination, the client is responsible for payment for all work completed up to the termination date. Emperor Creative Studio reserves the right to terminate immediately for breach of these terms.

These Terms of Service are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in New York County, NY.

We reserve the right to modify these Terms at any time. Changes take effect when posted to the Site. Continued use of the Site or our services after changes constitutes acceptance of the revised Terms.
